1. Service provider

2. Purpose
These terms and conditions govern access to and use of the obersys.com website, as well as the hiring of the website and custom software services offered by OberSys. By using the site, the user expressly accepts these conditions.
3. Services
OberSys offers the following services:
- Website for your business: design and development of a website with up to 4 sections, a catalog with WhatsApp buttons, Google Maps location, technical SEO, and registration and management of the first-year domain in the client's name.
- Custom systems: development and setup of web software to manage customers, stock, bookings, orders and internal processes.
- System support: monthly infrastructure and technical support service, with its cost defined in each quote based on the infrastructure used.
4. Hiring process
The process begins with a free consultation via WhatsApp or email. OberSys prepares a detailed quote that the client must approve in writing (email or message). The agreement is finalized only once the quote is accepted and the agreed deposit is paid.
Prices published on the site are for reference and are reviewed every three or four months. The final quote depends on the scope of each project and is valid for the period stated in it; the price that applies is the one in the approved quote.
5. Payment
The payment method is detailed in each quote. For custom systems, the project starts after a deposit of 30% of the quote; the balance is agreed case by case.
6. Delivery times
Delivery times are estimates and are stated in the quote. The timeline starts once the client delivers all the required materials (text, images, credentials and style references). Delays in delivering materials extend the timeline proportionally.
7. Revisions and changes
The website includes three rounds of revisions before launch; for custom systems, the number of rounds is defined in the quote. After launch, small text and contact updates to the website are handled within 48 business hours. Changes to structure, design or new features are quoted separately.
8. Domain, code and hosting
- The website domain is registered in the client's name. OberSys handles its technical management, and the yearly renewal is paid by the client.
- Website: one year after launch, the client may request the handover of the website to continue with another provider.
- Custom systems: the service covers use of the system, its hosting and its support. Handover of the source code is not included and is quoted separately.
- Websites and systems are hosted on accounts managed by OberSys.
- OberSys reserves the right to mention the work in its portfolio. The code, designs and materials produced by OberSys may not be resold or sublicensed without express authorization.
9. Liability
OberSys is not liable for losses or damages arising from the use of the software by the client or its users. Nor is OberSys liable for service interruptions by third parties (hosting, domains, external APIs) beyond its control. OberSys's maximum liability is limited to the amount actually paid for the service in question.
10. Late payment
If a monthly service is not paid by its due date, a surcharge will apply based on the interest rates published by the Central Bank of Argentina (BCRA). If two periods remain unpaid, OberSys may suspend the service until the account is brought up to date.
11. Cancellation
The client may cancel the project at any time. Amounts already paid are non-refundable. If cancellation occurs after development has started, OberSys may invoice the proportional work completed up to the cancellation date.
12. Governing law and jurisdiction
These terms are governed by the laws of the Argentine Republic, including Consumer Protection Law 24,240 and its amendments. In the event of any dispute, the parties submit to the jurisdiction of the Ordinary Courts of the City of Quilmes, Buenos Aires Province, waiving any other jurisdiction that may apply.
13. Clients outside Argentina
Prices for clients outside Argentina are expressed in US dollars (USD). Payment is made via PayPal, through a link that OberSys sends when it's time to pay. Payments are never collected through the website.
